This Privacy Policy of Swamp Yankee Oil (the “Company” “we,” “our,” or “us”) explains the collection, use, and sharing of information from or about you in connection with your use of the Access Points (defined below) and/or our products and services.  The term "Access Points" refers to, collectively, our various websites, mobile applications, onboard media, blogs, social media and other places, and other online or wireless offerings, whether accessed via computer, mobile device or other technology, any of which is owned or operated by us or on behalf.  

 
Unregistered Web Visitors
We do not collect automatically personal information from individuals who do not register on the Access Points and are just visiting. We don't knowingly probe visitor's computers or devices for personal information. We do collect visitor's Internet technical statistics, including IP addresses, referrers, the type of browser and type of workstation used. With this information, we may, for example, gain insight into how visitors find us on the Internet, and how many Windows vs. Mac users visit the Access Points. We use that information to improve our services to visitors and users. This information may help us, for example, to decide how much to invest in compatibility with different browsers.  

 

Registered Web User and Customers
A "registered" user to the Access Points is one who has elected to complete the registration page on to create an account on the Access Points and establish an ongoing, personalized experience with us. Most registered users purchase products or equipment or receive services from us. We collect personally identifiable information from you when you register as a user of the Access Points. The personal information we collect may include your name, billing and shipping address, email address, credit card or bank debit card information, including expiration date and security code, and mobile and home phone numbers. Your credit card information will be used only to process your transactions with us. Your credit card number and security code will not be stored on the Access Points. You are not required to provide personal information to view the Access Points, however, you will not be able to register as a user unless it is provided.  

 

We use the personal information you elect to submit to the Access Points as a registered user for our own research, advertising, promotional and marketing purposes, including sending you by postal and electronic mail information about products and services offered by us and by other companies that we think you will be interested in.  A customer, of course, might not be a registered web user of the Access Points, but we are committed to similar privacy safeguards for information gathered about you through non-online methods as well.  

 

We record our calls with prospective and actual customers, and confirm before doing so that we have your permission to record our call.  

 

The Company also collects various information from and about its customers as part of its routine business operations, including, but not limited to:

 

  • ordinary business transactions, such as fuel or equipment deliveries, service history and payments,
  • credit information from third party bureaus,
  • billing, service and delivery addresses and contact information,
  • characteristics of heating needs and/or systems used,
  • interactions with us or our affiliates or third-party partners,
  • when you view or use our products and services,
  • when you create a profile to register for and/or use a Company account,
  • when you contact our customer service or other means to request information from us,
  • when we respond to your inquiries,
  • when you participate in sweepstakes or other promotions, access interactive services or view webcasts, review newsletters that we or our affiliates or third-party business partners may offer from time to time,
  • you provide quotes, photos or other personal information that you provide to us when we communicate with you about our products and services, or
  • other information incident to the provision of fuel, equipment and the services we provide or plan to provide.

 

We also receive personal information when you apply for a job in any “careers” section of our websites. Any such personal information gathered through that section will be used solely to evaluate whether your background and experience make you a candidate for a career with the Company.

We may collect information about you (including personal information) from various third party services, including from Access Points owned or operated by third parties. For example, we may receive information about you (including personal information) when you interact or connect with us or our Services, for example, by liking us on Facebook® or following us on Twitter® or on Instagram® or watching us on YouTube®. The collected information may be information associated with that third-party service, or that you elect to make public using that service or have authorized the third-party service to share with us (such as your user ID, billing information, public profile information, email address, birthday, friends list, pages you have "liked" or commented on, and other account and profile data). The information we receive is dependent upon your privacy settings with the third party. You should always review, and if necessary, adjust your privacy settings with third-parties before interacting or connecting with us through them. We are not responsible for their privacy practices or content. We may combine the information we collect from or about you, including through the cookie technologies described, with your personal information, and use it in the manner described in this Privacy Policy or as otherwise permitted by law.

 

This information may be collected via the Access Points, in print application, by phone or other forms, methods or in person. 

USE OF INFORMATION

 

In general, we use the information (including personal information) we collect from or about you (including without limitation, through technologies such as those described in this Privacy Policy primarily to provide better customer service to you, to improve and customize the content you see, to help recognize you when you use other devices, to provide the Services you request, and to contact you about special promotions and new Services and for purposes including the following:

 

  • customizing or personalizing our products and services to your needs and evaluating how well our products and services perform;
  • customizing, targeting or personalizing our advertising that you view and monitoring the effectiveness of our email communications and other advertising efforts;
  • to provide you with the products and services you request; to manage your account, including processing bills and providing notifications;
  • remembering information so that you will not have to re-enter it during your visits to, or the next time you visit, the Access Points;
  • to reward you as part of any reward and recognition program we offer and you choose to join;
  • to solicit information from you, including through surveys;
  • to resolve disputes, collect fees, or troubleshoot problems
  • monitoring the effectiveness of the Access Points;

  • preventing potentially illegal or harmful activities, including fraud;

  • planning for, improving and enhancing our products and services; and
  • any other purpose that is required or permitted by law or that is disclosed to you at the time we collect the information or that is related to a request made by you.

               

We use payment information, such as credit card numbers and billing ZIP code, to complete your reservations and provide the Services to you. For example, we use payment information to process payments for products and services (we use a third-party payment processor to do this), to retrieve account information, to determine whether you are eligible for promotions, and to detect abuse of the products and services.

 

In addition to the information (including personal information) described in this Privacy Policy, we may aggregate information about you and other individuals together, or otherwise "de-identify" the information about you (which means that the information does not identify you personally). We may use information in these forms for any legitimate business purpose, including without limitation, for research and analysis, administration of the products and services, advertising (e.g., improving our targeting efforts or our products and services), and promotional purposes.

 

In order to access certain of the Services from your mobile device or browser, you may be required to share your device’s precise location data (e.g., latitude and longitude) with us. This location data may be used to provide tailored products and services to you based on your location.

 

The analytics tools that collect information sent by your browser or mobile device, including the pages you visit, your use of third party applications, and other information assists us in analyzing and improving the Access Points.

 

Information We Disclose to Others
We may share information (including personal information) with third-party vendors who provide functions on our behalf, including credit card processing, business analytics, customer service, marketing, distribution of surveys or sweepstakes programs, and fraud prevention. We may also authorize third-party vendors to collect information on our behalf, including as necessary to operate features of our websites and other Access Points. Third-party vendors have access to and may collect personal information) only as needed to perform their functions and are not permitted to share or use the information for any other purpose and are required to adopt data security practices consistent with our practices.

 

We may from time to time contract with third party vendors to serve ads to our customers on our behalf across the Internet or to send our direct mail to customers whom we think may be interested in our products or services. To do this, the vendors will collect anonymous information about your visits to our Access Points and your interaction with our products and services. This anonymous information is collected through the use of a cookie or pixel tag – industry standard technology used by most major web sites. No personally identifiable information is collected in this process. They may also pool the anonymous information that they collect with other sources of information not collected during your visit to our website, which may include your name and mailing address, for purposes of determining whether you might be interested in receiving information.

 

Other than described in this Section, we disclose personally identifiable information to third parties (i) only with your permission, or (ii) when the Company is compelled by law, contract, policy or otherwise determines it should cooperate with governmental authorities, such as to respond to subpoenas or other legitimate inquiries, in connection with a stolen credit or bank card, identity theft, fraud or other criminal investigation, to defend against legal claims, or otherwise, in accordance with the procedures prescribed by relevant laws, contracts or policies, (iii) in connection with a sale or merger of the Company or any part of the Company or its assets (including a sale while in bankruptcy) or (iv) when we believe it is appropriate to investigate, prevent, or take action regarding illegal or suspected illegal activities or exercise, defend or protect the rights, property or safety of our company, our customers, our Access Points or others.  In such cases we reserve the right to raise or waive any legal objection or right available to us; to enforce our Terms of Use, or any other agreement we or another party may have with you.

 

We may disclose aggregated information collected from visitors and users to the Access Points and our customers to third parties. 

 

Cookies and Standard Web Practices
The Access Points make use of cookies for some features. Cookies are not required to visit or view all pages on the Access Points, but you will need to enable cookies to perform some functions on the Access Points.   A "cookie" is a small text file that is stored on your computer when you access a website, app or platform. Cookies can perform useful functions, such as allowing you to return to a website or platform or app and be recognized without having to restart an authentication process or type in your registration information.  Browsers such as Microsoft Internet Explorer allow you to block the storage of cookies. While you may block the storage of cookies, know that some functions on the Access Points will not work properly without cookies. In general, cookies are used to identify a session as unique.

 

The cookies on the Access Points owned or operated by the Company are not used by the Company for systematic tracking of its customers other than the methods mentioned below:

 

  • Web Usage Tracking: The Company employs various software tracking techniques to produce website traffic reports to understand and improve the Access Point experience for visitors and customers. These reports compile individual user visits anonymously.
  • Secure Transmissions to Our Servers: We use a widely used encryption technology called SSL to encode sensitive information when you transmit it to us through the Access Points. This is generally the same technology used by your banks. Once your personally identifiable information is saved on our servers, we utilize a combination of operational, procedural and physical safeguards to secure your personally identifiable information from unauthorized use or compromise. To further reduce risk of compromise, not all data on our customer accounts is available through the Access Points.
  • Email Security: Sensitive information about customer accounts is not transmitted by us to you via electronic mail. Our visitors, registered users and customers are reminded that email is not a secure transmission method, and should not be used to exchange private information with the Company, especially account numbers and permanent passwords.

 

The cookies on websites, mobile applications, onboard media, blogs, phone, in person, social media and other places, and other online or wireless offerings, whether accessed via computer, mobile device or other technology which are not owned or operated by the Company, but may be linked or accessible via the Access Points, are governed by the terms of use of the third parties who control those websites, mobile applications, onboard media, blogs, phone, in person, social media and other places, and other online or wireless offerings.

 

YOUR CHOICES ABOUT YOUR INFORMATION

This section describes the choices regarding how we and third parties use certain information collected from or about you.

 

Part of the responsibility for storing your personally identifiable information securely is to provide you with a means of correcting information you find to be inaccurate. The Company provides a means for online updating and verification of some information you provide to us through your registration account. In addition, other customer information collected by us through other business transactions we conduct with you can be updated by you by calling our customer service center at the number below.

 

The Company is committed to communicating with you in meaningful ways that we feel will be to your advantage. For instance, our marketing materials may include tips for heating and cooling, or suggestions on how best to manage a the Company account. However, if you wish, you can instruct the Company at any time not to use your personally identifiable information for marketing and educational purposes by contacting us at Customer Service as provided below. When calling, please provide your registration information or the Company account number.  Even if you opt-out of marketing or education materials, we will still contact you and send you materials about your account, including the purchases you have made and amounts that are due.

 

Security
The cares about the security of your information, and uses commercially reasonable physical, administrative, and technological safeguards to help preserve the integrity and security of all information collected through our website. However, no security system is impenetrable and we cannot guarantee the security of our systems 100%. In the event that any information under our control is compromised as a result of a breach of security, the Company will take reasonable steps to investigate the situation and where appropriate, notify those individuals whose information may have been compromised and take other steps, in accordance with any applicable laws and regulations. If we suspect there is security breach or other unauthorized activity involving your account, we may post a notice on our website, or try to contact you using your email or postal address or telephone in your registration details. 

 

We store your credit card and bank account information with industry standard encryption algorithms.  For purposes of security, when you complete your registration with the Company, you will have a unique log in. This log in information is for you to authenticate yourself when using your registered account. Additionally, you will be responsible for creating a secret password that will be used to access your Company account. You are responsible for ensuring the security and confidentiality of the password. Keep your password in a safe and secure place and do not share it with anyone. You are responsible for any activity using the password and login and that any activity engaged in using the password you specified during registration will be deemed to have been engaged in by you. If you think someone has obtained your login or password, please immediately our customer service center at the number below.  

 

Privacy At Other Access Points
The Access Points may integrate with or contain links to other third party websites and services. We are not responsible for the practices employed by third party websites or services embedded in, linked to, or linked from the Access Points and your interactions with any third-party website or service are subject to that third party’s own rules and policies.

 

Changes To Our Privacy Policy

By using or accessing the Access Points, you consent to the collection, use and storage of your information by us or our third party business partners in the manner described in this Privacy Policy and elsewhere on the Access Points. We reserve the right to make changes to this Privacy Policy from time to time. If this Privacy Policy changes in any material way, we will place an updated version on this page. Regularly reviewing this page ensures that you are always aware of what information we collect, how we use it and under what circumstances, if any, we will share it with other parties. Your continued access to the Access Points and/or use of any of our websites or purchase or use of the Services after any such changes constitutes your acceptance of, and agreement to be legally bound by, this Privacy Policy, as revised.

 

Governing Law & Arbitration; Waiver of Class Action Claims

By accessing the Access Points, you consent to the collection, storage, and processing of information under U.S. laws and as provide by this Privacy Policy.   You agree that any and all claims, disputes, controversies, actions or proceedings relating to, or arising out of information or this Privacy Policy (collectively "Claims"), shall be governed by the internal substantive laws of the State of Connecticut without regard to its conflict of laws principles and that any and all Claims shall be resolved exclusively by final and binding arbitration administered by the American Arbitration Association ("AAA") as provided in the Terms of Use and that all Claims shall be subject to the Section in the Terms of Use entitled Governing Law & Arbitration; Waiver of Class Action Claims.
